1. The agreement
These terms govern your participation in the Secret Labs affiliate program (the "Program"). By applying, you agree to them. Every application is reviewed and accepted by us individually; applying does not create an affiliate relationship until we accept you.
2. Eligibility
To join and to remain in the Program you must:
- be at least 18 years old;
- be a United States person for federal tax purposes, and provide a valid Form W-9. An affiliate who is not a United States person may take part only where Secret Labs has approved that participation in writing;
- provide accurate, current identity, country and contact information, and keep it up to date;
- provide accurate payment information in your own name, or in the name of a business you are authorised to act for;
- be legally able to take part, and not be subject to any legal restriction that prevents us from paying you;
- follow the rules of every platform on which you promote;
- hold one affiliate account only, unless we agree otherwise in writing.
We may ask you to verify any of the above, and may pause participation or payment while a question is outstanding.
3. Commission
- Qualifying referrals earn 10% of the product subtotal. This rate applies to every tracked referral, whether the customer arrives through your affiliate link or uses an affiliate coupon code.
- Commission is calculated on the product subtotal only. Shipping, shipping tax, product tax, tips, gift-card purchases and any discount applied to the order are excluded.
- Commission is earned on orders that are paid, fulfilled, and not returned, refunded or charged back.
- On subscription or recurring orders, commission is paid on the first order only. Renewals and later recurring charges do not earn commission.
- Purchases you make yourself, or that are placed for you or on your behalf, do not earn commission.
- The rate in force is the rate stated in these terms as published on the affiliate signup page.
4. How an order is credited
One affiliate is credited per order, in this order of priority:
1. a customer who has been connected to a specific affiliate;
2. an affiliate coupon code used at checkout;
3. a product connected to a specific affiliate;
4. an affiliate link, tracked by cookie for 30 days from the click.
A coupon code therefore outranks an affiliate link. If a customer arrives through one affiliate's link and then uses a different affiliate's coupon code, the order is credited to the affiliate whose coupon was used, and the link affiliate is not credited for that order. Where two links are involved, the most recent link before the order is credited.
Cookies can be blocked, cleared or expire, and coupon use depends on the customer entering the code, so not every sale you influence will be tracked. We credit what our systems record. We review referrals before approving them, and may decline a referral that is untracked, duplicated, fraudulent, or in breach of these terms.
5. How you may promote
You may promote our products through your own content, audience and channels, including paid promotion, subject to the following.
Brand terms in paid advertising. In any paid advertising, including paid search, shopping, marketplace, app-store and paid social, you may not bid on, or deliberately target, "Secret Labs", "Secret Labs USA", our logos, our product names, or misspellings or close variants of any of them, as keywords, search terms, placements or audience targets. This restriction applies to how you buy and target advertising. It does not prevent you from accurately naming Secret Labs or our products inside otherwise permitted paid creative: you may show, name and review the products you are promoting.
You may not:
- use your own link or coupon code on your own orders, or arrange for anyone else to do so on your behalf;
- post coupon codes to coupon, deal, cashback or browser-extension sites, or anywhere they can be scraped, unless we ask you to;
- impersonate Secret Labs, register domains, social accounts, app listings or email addresses containing our name, or present yourself as an employee or spokesperson;
- send unsolicited bulk email or messages, or promote through spyware, adware, toolbars, cookie-stuffing, iframes or forced clicks;
- promote alongside content that is illegal, sexually explicit, hateful, harassing, or directed at children;
- create a code, discount or offer we did not issue you, or combine offers to reach a price below one we have set.
6. Product handling and resale
- Our products may be diluted only as the current approved product label directs. Dilution ratios, uses and surfaces outside the label are not permitted.
- Repackaging, relabeling, decanting into other containers, adulteration, and any other alteration of the product or its packaging are prohibited.
- Unauthorised resale is prohibited, including sale on marketplaces such as Amazon, eBay, Walmart or TikTok Shop, and wholesale or distribution to third parties, without our written permission.
7. Disclosure
- Every post, video, story, stream, email or message in which you promote our products must clearly disclose that you earn a commission.
- Your own disclosure is required in addition to any platform tool. A platform's paid-partnership label, branded-content toggle or similar feature does not satisfy this section on its own; you must also disclose in your own words within the content.
- The disclosure must be in the same language as the content and visible without clicking "more", scrolling past the content, or opening a bio or link page.
- You are responsible for following the Federal Trade Commission's endorsement guidance and the rules of each platform you use.
8. What you may say about the products
- You may make only those claims that appear in the current Secret Labs approved product label, the product page on secretlabsusa.com, or affiliate materials we have supplied to you.
- Safety data sheets are not a source of marketing claims; do not quote or paraphrase them in promotional content.
- Do not invent performance, safety, durability or environmental claims, do not promise a result, and do not state that a product is safe for a surface we have not listed.
- Do not state that a product is approved, certified, tested or endorsed by anyone unless we have confirmed it in writing.
- Do not make health, medical or "non-toxic" claims.
- Show the product being used as the label directs, including any protective equipment the label requires.
- If content misstates a product, we may ask you to correct or remove it, and you agree to do so promptly.
9. Links and coupon codes
- Links and coupon codes are issued by us, are personal to you, and may not be transferred, resold or shared with another promoter.
- We set each code's name, discount, limits and expiry. You may not rename or alter a code.
- We may change, pause or withdraw a code at any time. Where a change reduces what you earn, section 12 applies.
10. Returns, refunds and cancellations
Our customer return window is 30 days from delivery. Commission on an order that is returned, refunded, cancelled or charged back is reversed, including after it has been approved. Where commission has already been paid on such an order, we may deduct the amount from your next payment.
11. Payment
- Commission is recorded as Pending, is reviewed, and becomes Approved once the order is settled and the return window has passed.
- All commission is calculated and paid in US dollars.
- The minimum payout is $25.00. An approved balance below $25.00 is not paid out; it rolls forward and is added to your next balance until the total reaches the minimum.
- Approved balances are reviewed at month end, and payments for balances at or above the minimum are made by the 15th of the following month.
- Payment is made by PayPal to the address recorded on your affiliate profile. Keeping that address current is your responsibility, and we are not responsible for a payment sent to an address you have given us.
- Any fee your payment provider charges to receive money is yours.
- Commission is not payable on an order we have declined under these terms.
12. Changes to the Program
We may change these terms, the commission rate, the cookie period, coupon rules or payment terms. Changes apply prospectively. Where a change reduces what you earn, we will give you at least 14 days' notice by email to the address on your affiliate account before it takes effect, and referrals already tracked before the effective date are settled on the terms that applied when they were tracked. Changes that do not reduce what you earn, and changes required by law, may take effect immediately. The current version of these terms is published on the affiliate signup page.
13. Taxes
You take part in the Program as an independent contractor. These terms do not create employment, agency, partnership or a joint venture. You are responsible for your own taxes.
Before we make any payment to you, you must provide the appropriate tax documentation: a completed Form W-9 if you are a United States person, or, where Secret Labs has approved your participation as a non-United States affiliate in writing, the applicable United States foreign-status documentation. You must also provide updated documentation whenever we reasonably request it, including when your circumstances, name, entity type or country change, or when a form expires.
Until complete and accurate documentation is on file, we may hold payment, and we may apply any withholding the law requires to amounts we do pay. We issue information returns, such as Form 1099-NEC, where the law requires it. If you are outside the United States, you are responsible for declaring commission where you live.
14. Your content and our brand
- We grant you a limited, non-exclusive, revocable licence to use the Secret Labs name, logo and the product images we supply, solely to promote our products while you are in the Program. Do not alter our logo, and do not use our marks in your handle, domain, business name or advertising identity.
- You keep ownership of the content you create.
- You grant us a non-exclusive, royalty-free licence to repost, in organic channels only, content you have already posted publicly promoting our products, with reasonable credit to you, while you are in the Program.
- Separate written permission is required for any paid advertising use of your content, for whitelisting or running ads from your account, for editing beyond cropping, trimming for length or format conversion, and for any use after your participation ends.
- When your participation ends, the licence in this section ends, and you must stop using our marks.
15. Ending your participation
- You may leave the Program at any time by emailing support@secretlabsusa.com.
- We may suspend or end your participation at any time, with notice where practical.
- Where we end your participation because of a breach of sections 5, 6, 7 or 8, unpaid commission connected with that breach is not payable. Otherwise, approved commission earned before your participation ends is paid in the normal cycle.
- When your participation ends, you must stop using our marks, links and coupon codes, and correct or remove content as we reasonably ask.
16. Responsibility and liability
The Program is provided as is. You are responsible for your own promotional content and for your own compliance with the law, including the disclosure and claim rules above. To the fullest extent permitted by law, we are not liable for lost profits, lost opportunity or indirect losses, and our total liability to you is limited to the commission payable to you in the three months before the claim. Nothing in these terms limits or excludes any liability that applicable law does not permit us to limit or exclude.
17. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
